Military Medical Provider Representation
Are you a military health professional who is facing any type of legal issue at Joint Base Elmendorf–Richardson? You need a top military medical provider on your side. Our team can review your case, answer questions, and help you protect your career. Here is a key point to know:
- Clinical Adverse Action Process: Military medical providers are subject to a unique set of standards and regulations that govern their professional conduct and performance. When allegations of misconduct or incompetence arise, the Clinical Adverse Action Process is initiated. The process includes a thorough investigation, a review by peer panels, and, in some cases, a formal hearing. Our role is to provide strategic legal guidance through each step. Our JBER military defense lawyer will protect your rights as a medical provider.
Adverse Administrative Actions
Adverse administrative actions encompass a broad spectrum of disciplinary and career-impacting measures that fall short of court-martial but can still have serious and permanent consequences for a service member’s future. These actions can include:
- Discharge Boards / Separation Boards: When a commander initiates proceedings to involuntarily separate a Soldier or Army officer, the stakes are high. These boards determine whether a service member should be retained, separated, or discharged under other than honorable conditions—potentially ending a military career and affecting future benefits.
- Show Cause Boards: For officers, a Show Cause Board determines whether an individual should be retained in the military following allegations of misconduct or substandard performance. These are high-level proceedings that require experienced legal representation to protect a lifetime of service.
- Administrative Reductions in Rank: Service members can lose their rank and corresponding pay grade through administrative actions, often with little notice. These reductions can be career-ending, particularly for noncommissioned officers and those approaching retirement.
- Letters of Reprimand (LOR) and General Officer Memoranda of Reprimand (GOMOR): These written reprimands can be placed in either a local or permanent file and are often used as a tool to force a service member out of the military. A GOMOR in particular—especially if filed in the AMHRR—can be career-ending, even if the underlying allegation doesn’t result in criminal charges.
While Article 15s (nonjudicial punishment) are one form of adverse administrative action, they are generally used for minor misconduct and do not carry the long-term impact of the proceedings listed above. However, even an Article 15 can become a gateway to more serious consequences if not handled properly.
At Mangan Law, we focus on protecting Soldiers and Officers facing the full range of adverse administrative actions. Our goal is not just to fight the immediate threat—but to preserve careers, benefits, and reputations.
Court-Martial Representation
Good order and strong discipline is essential for the military. A military service member can be subject to a court-martial for a violation of the Uniform Code of Military Justice (UCMJ). We provide solutions-focused court-marital representation to service members stationed at Joint Base Elmendorf–Richardson. There are actually three different types of court-martial proceedings:
- General Court-Martial (GCM): A General Court-Martial (GCM) is the highest court in the military justice system. It handles the most serious offenses—such desertion, rape, and murder. It consists of a military judge and a jury of eight (or a judge alone if the accused opts for it). The GCM has the authority to impose any sentence, including death.
- Special Court-Martial (SPCM): A Special Court-Martial (SPCM) is an still a formal criminal court, but with reduced authority to punish. SPCMs typically deal with moderately serious offenses. Many issues that are similar to “misdemeanor offenses” under civilian law are handled by a SPCM.
- Summary Court-Martial (SCM): Summary Court-Martial (SCM) addresses minor offenses within the military. It serves as a simplified process and does not require a judge or jury. SCMs are presided over by a single officer, not a military judge. Penalties are more severe that those given under Article 15, and the accused can still hire a lawyer.
